Los tres conceptos mencionados en el título de mi presentación son conceptos referenciales negativos, es decir, constituyen el rechazo o apartamiento de conceptos supuestamente más básicos cuales son -en este caso- los de unidad, semejanza e igualdad. Si se admite esta aproximación conceptual, pienso que también cabe admitir que el valor o disvalor de aquellos dependerá de la concepción que uno tenga de estos últimos. Dado que, a su vez, la semejanza y la unidad pueden, en cierto modo, ser referidas (...) a la igualdad, intentaré aquí precisar el concepto de igualdad (I), recordaré algunas versiones de un pluralismo que considero moral y políticamente inaceptable (II) y, finalmente, propondré distinguir entre aquellas desigualdades que necesariamente habrán de darse en toda sociedad democrática y las discriminaciones socio-culturales propias de regímenes totalitariamente excluyentes (III). The paper contains a conceptual analysis of “act of toleration” and the property of “being tolerant”. Being tolerant is understood as a dispositional property of persons manifested in what the author calls the “circumstances of toleration”. The main circumstances distinguished are: a tendency to prohibit a certain behaviour and the competence to determine the deontic status of the behaviour in question. An act of toleration, then, consists in not prohibiting (or cancelling the prohibition of) that behaviour. It is argued that (...) this requires the existence of two different normative systems, the “basic system”, and the “justifying system”. Acts of toleration must be based on reasons coming from the latter. This insight enables one to establish a difference between reasonable and unreasonable toleration, as well as between toleration and related concepts like indifference, acquiescence, etc. The analysis also introduces the distinction between “vertical” and “horizontal” toleration. Acceptance of this last category implies that toleration does not necessarily require hierarchical relationships between those who tolerate and those whose actions are tolerated. (shrink)

The article analyses the distinction between the private and the public sphere from a conceptual and from a normative point of view. On the conceptual level, it is argued that the common dichotomous view is incomplete, giving rise to conceptual confusions which can be overcome by a careful distinction between the intimate and the private sphere. While the boundary between the private and the public is a conventional matter, the sphere of intimacy, including thoughts as well as a certain type (...) of actions, is empirically delimited. On the normative level, a number of arguments for or against the extension or restriction of the private sphere as well as for or against the intervention of the state in its citizens’ spheres of intimacy is discussed from a liberal point of view. Un problema puede ser viejo por persistente, porque todavía no se ha encontrado la respuesta adecuada. Pero también puede ser viejo por recurrente, por reaparecer cuando se eliminan las condiciones que hicieron posible su solución en el pasado. Y un problema es nuevo cuando es el resultado de desafíos inéditos o hasta ahora desconocidos. El Estado de Derecho y Terrorismo es un viejo problema recurrente. El impacto de las investigaciones neurológicas en el concepto de responsabilidad es un viejo problema persistente. (...) La erosión de las estructuras institucionales a nivel internacional es un viejo problema persistente. Un nuevo problema es la relación entre ética, política y derecho desde el punto de vista de una fi losofía analítica. Enfrentarse a estos viejos y nuevos problemas de la fi losofía del derecho desde una perspectiva analítica en el contexto de América Latina es una tarea doblemente difi cultosa. (shrink)

Continuous recordings of brain electrical activity were obtained from a group of 176 patients throughout surgical procedures using general anesthesia. Artifact-free data from the 19 electrodes of the International 10/20 System were subjected to quantitative analysis of the electroencephalogram (QEEG). Induction was variously accomplished with etomidate, propofol or thiopental. Anesthesia was maintained throughout the procedures by isoflurane, desflurane or sevoflurane (N = 68), total intravenous anesthesia using propofol (N = 49), or nitrous oxide plus narcotics (N = 59). A set (...) of QEEG measures were found which reversibly displayed high heterogeneity of variance between four states as follows: (1) during induction; (2) just after loss of consciousness (LOC); (3) just before return of consciousness (ROC); (4) just after ROC. Homogeneity of variance across all agents within states was found. Topographic statistical probability images were compared between states. At LOC, power increased in all frequency bands in the power spectrum with the exception of a decrease in gamma activity, and there was a marked anteriorization of power. Additionally, a significant change occurred in hemispheric relationships, with prefrontal and frontal regions of each hemisphere becoming more closely coupled, and anterior and posterior regions on each hemisphere, as well as homologous regions between the two hemispheres, uncoupling. All of these changes reversed upon ROC. Variable resolution electromagnetic tomography (VARETA) was performed to localize salient features of power anteriorization in three dimensions. A common set of neuroanatomical regions appeared to be the locus of the most probable generators of the observed EEG changes. (shrink)

Recent advances in medical technology, notwithstanding their potential blessings, have engendered a number of new ethical problems. Questions raised by rapidly improving techniques for the transplantation of human organs and body tissues have become especially urgent, The article tries to clarify and evaluate the main arguments advanced for and against different arrangements in this area. The first part concentrates on the problem of acquisition. The ethical status of eight ways of obtaining human body parts is investigated. The cases are derived (...) from combinations of three criteria: whether the donor consents or not; whether or not he/she is alive or dead at the time of extraction; and whether or not donors are compensated. In the second part, the problem of adjudication is treated. Three possible arrangements are examined: market, organ bank, and club. (shrink)

En el presente trabajo se intenta ilustrar con ejemplos de la historia y de la actualidad constitucional de América Latina la paradójica actitud de no pocos juristas y políticos latinoamericanos que simultáneamente profesan una fe inconmovible en el poder de conformación social del ordenamiento jurídico a la vez que aceptan su precaria eficacia. La Constitución se convierte en un mito político y la impunidad en sinónimo de poder. En tales condiciones, parece aventurado establecer una relación causal entre orden constitucional y (...) democracia. Sólo una política jurídica que tome en serio los derechos y deberes constitucionales podrá quizás revertir esta situación. Desgraciadamente la probabilidad de que tal sea el caso a fines del siglo XX es menor que a comienzos de la centuria. (shrink)

Paternalism, understood as coercive intervention with the behavior of a person in order to prevent her from causing harm to herself, is a highly controversial issue, because it implies a departure from the widely recognized principle of harm to others. Some conceptual differences between legal paternalism and other forms of state coercion that also depart from the principle of harm to others will be indicated. This is followed by an analysis of the arguments that are usually brought forth against legal (...) paternalism. And finally, the possibility of determining ethically justifiable types of legal paternalism is explored. (shrink)

Jerry Fodor and Ernest Lepore [(1992) Holism: a shopper's guide, Oxford: Blackwell; (1996) in R. McCauley (Ed.) The Churchlands and their critics , Cambridge: Blackwell] have launched a powerful attack against Paul Churchland's connectionist theory of semantics--also known as state space semantics. In one part of their attack, Fodor and Lepore argue that the architectural and functional idiosyncrasies of connectionist networks preclude us from articulating a notion of conceptual similarity applicable to state space semantics. Aarre Laakso and Gary Cottrell [(1998) (...) in M. A. Gernsbacher & S. Derry (Eds) Proceedings of the 20th Annual Conference of the Cognitive Science Society, Mahway, NJ: Erlbaum; Philosophical Psychology ] 13, 47-76 have recently run a number of simulations on simple feedforward networks and applied a mathematical technique for measuring conceptual similarity in the representational spaces of those networks. Laakso and Cottrell contend that their results decisively refute Fodor and Lepore's criticisms. Paul Churchland [(1998) Journal of Philosophy, 95, 5-32 ] goes further. He uses Laakso and Cottrell's neurosimulations to argue that connectionism does furnish us with all we need to construct a robust theory of semantics and a robust theory of translation. In this paper I shall argue that whereas Laakso and Cottrell's neurocomputational results may provide us with a rebuttal of Fodor and Lepore's argument, Churchland's conclusion is far too optimistic. In particular, I shall try to show that connectionist modelling does not provide any objective criterion for achieving a one-to-one accurate translational mapping across networks. (shrink)

Introducción: las tecnologías de la información y las comunicaciones se utilizan cada vez más en las universidades como medios de enseñanza. Se ha optado por el uso de los objetos de aprendizaje para lograr la reutilización, accesibilidad, durabilidad e interoperabilidad en sus recursos educativos. Objetivo: enunciar algunos de los valores humanos que se que se manifiestan en el proceso de autoformación con los objetos de aprendizaje. Método: se utilizó la observación como método científico durante el proceso enseñanza-aprendizaje con los objetos (...) de aprendizaje para la autoformación de los estudiantes. Resultados: se enunciaron algunos valores intelectuales, éticos, estéticos, físicos, morales y sociales, que se revelan en el proceso de autoformación con los objetos de aprendizaje. Conclusiones: Los valores humanos que manifiestan los estudiantes durante el proceso de autoformación con los objetos de aprendizaje sirven para establecer juicios de valor consistentes, derivados de modos de pensar y sentir que les permitan enfrentar sus decisiones vitales. Introduction: Information technology and communications are increasingly used in universities as teaching means in the teaching-learning process. The use of learning objects has been opted to achieve reusability, accessibility, durability and interoperability in its educational resources. Objective: To enunciate some human values occurring in the process of self-education with learning objects. Method: The observation as a scientific method for the teaching-learning process with learning objects for independent self-training of students was used. Results: There have been enunciated some intellectual, ethical, aesthetic, physical, moral and social values that are revealed in the process of self-training with learning objects. Conclusions: The human values that students showed during self-training with learning objects serve to establish consistent value judgments derived from modes of thinking and feeling that enable them to cope with their vital decisions. Se trata de mostrar y analizar algunas de las lecturas que se han hecho de la obra de Mohandas Gandhi en América Latina en las últimas décadas, a través de un escrito que se balancea entre una investigación empírica y el estudio de un caso que permite presentar dos problemas teóricos. Para esto se abordan autores y autoras de diversos países de la región, que permiten aludir a dos problemas teóricos que se formulan en este trabajo: la circulación de las (...) ideas entre regiones Sur-Sur, la reelaboración de las ideas en la región receptora. Estos problemas son claves en el desarrollo de los estudios eidéticos como disciplina. Se realiza una introducción respecto a la recepción de las ideas de Gandhi en la región hacia 1930, estudiando las articulaciones del pensamiento de éste con otros autores y tendencias de pensamiento y señalando algunas recepciones y cruzamientos posteriores. Luego el trabajo se focaliza en estudiosos de Argentina, Brasil, Chile, México, Nicaragua, Puerto Rico y Venezuela, tratando de presentar varios casos diferentes y que cubran numerosos países de la región, apuntando a un muestreo válido, aunque sin suficiente afirmación metodológica. The intention of this work is to show and analyze some of the readings that have been done about Mohandas Gandhi’s work in Latin America in the last decades, by means of a writing that swings between an empirical research and the study of a case that allows to present two theoretical problems. For this there are approached authors and authoresses of diverse countries of the region, who allow to allude to two theoretical problems that are formulated in this work: the flow of the ideas between South-South regions, the reformulation of the ideas in the receiving region. These issues are key to the development of the eidéticos studies as a discipline. An introduction is made regarding the reception of the ideas of Gandhi in the region by 1930, studying the joints of his thought and of those of other authors and trends of thought, pointing out some receptions and later crosses. Then the work focuses in experts of Argentina, Brazil, Chile, Mexico, Nicaragua, Puerto Rico and Venezuela, trying to present several different cases covering numerous countries of the region, pointing at a valid sampling, though without sufficient methodological affirmation. El cielo del siglo III a.e.c. aparece como materia viva semiótica, poetizable y divulgable, dispuesta como un λóγος para el bienestar del hombre, quien es un lector potencial de signos que le permiten intervenir (...) en el mundo. ABSTRACT The article addresses the thought of E.M. Cioran from the perspective of that vital uneasiness known as the sentiment of death. Although the term appears only in his first book, the idea cuts across his entire work given that, for Cioran, human beings intuit themselves as possessed by death at every moment of their lives. When persons are faced with a meaningless reality, dominated by radical and limiting circumstances such as pain and agony, the whole tenor of life changes until it becomes a tragic intuition of life.
